PRE-ARBITRATION DISPUTE RESOLUTION PROCEDURE

If you have a dispute that our customer service representatives can’t resolve and you wish to pursue arbitration, you must complete the following steps:

1. You must first submit an individualized Notice of Dispute to us using this Claim Form. The Notice of Dispute must be personally signed by you, completed accurately and in full, accompanied by documents reasonably necessary to support your claim (such as a proof of purchase), and sent by email to arbitration-claims@amazon.com or by regular mail to: Notice of Dispute, Amazon.com, Attn: General Counsel, P.O. Box 81226, Seattle, WA 98108-1226. We will provide you with the same information via your Amazon account’s primary email address if we have a dispute to pursue with you.
2. Upon receipt of a Notice of Dispute, you and we agree to negotiate in good faith for 60 days to try to resolve the dispute. If we request a conference during this period, you agree to cooperate in scheduling that conference and to personally participate in it by phone or video conference. Either side can bring counsel, but the conference must be individualized to our dispute, even if counsel represents other parties. For claims covered by the Notice of Dispute, any statute of limitations will be tolled from the date the notice is received until the later of (i) 60 days, or (ii) after a timely requested settlement conference is completed.
3. You and we agree that contacting customer service and completing the Notice of Dispute, the 60-day negotiating period, and any timely requested settlement conference are prerequisites to filing an arbitration (and to JAMS accepting that filing or initiating proceedings), and that a court can enjoin the initiation or proceeding of an arbitration in breach of these pre-arbitration dispute resolution requirements. If you or we seek an injunction from a court on this basis, then you and we agree that the arbitration (and any obligation to pay arbitration fees) will be stayed until that request is resolved and all appeals exhausted.
