Amazon Astro Terms of Use

This is an agreement between you and Amazon.com Services LLC (with its affiliates, "Amazon" or "we"). Before using Astro or Astro Services, please read these Astro Terms of Use, including the Amazon Device Terms of Use, the Alexa Terms of Use, the Amazon.com Privacy Notice, the Amazon.com Conditions of Use, and the other applicable rules, policies, and terms posted on the Amazon.com website, available through Astro or Astro Services, or provided with Astro (collectively, this "Agreement"). By using Astro or Astro Services, you agree to the terms of this Agreement on behalf of yourself and all other persons who use or interact with Astro or Astro Services under your account. If you do not accept the terms of this Agreement, then you may not use Astro.

For purposes of these Astro Terms of Use:

"Astro App" means the app provided by Amazon that provides access to Astro Services, including Astro settings, Astro-related content, and other information.

"Astro" means the Amazon Astro device and any Amazon accessories for the device.

"Astro Information" means all information related to Astro and Astro Services, including audio, video, images, or other inputs (such as video streamed to the cloud during live view, notifications provided to you, or information related to Astro’s movements throughout its environment and interactions with people), information provided to you through Astro or Astro Services, or information we receive in connection with Astro Services. 

"Astro Services" means all services we provide related to Astro, including, for example, the Software, the Astro App, and Alexa voice services (which are subject to the Alexa Terms of Use).

"Maps" are representations of an environment in which Astro is deployed and all related information, including the layout and contents of that environment such as the positions of walls and obstacles, room names you assign, and Astro’s operations and interactions within it. This may include, for example, measurements of wifi signal strength in different areas, information about where Astro interacts with you or others in its environment, and other inputs.

"Software" means all software and applications that we make available to you in connection with Astro Services.

1. Astro and Astro Services

1.1 Astro. Astro and an internet connection are required to access and use Astro Services. Some Astro Services may not be available in all areas and may require separate subscriptions. Astro Services may not be available if Astro is in a location where it cannot connect to the internet.

1.2 Use of the Software. You may use the Software only on or through Astro or the Astro App, and you may only make personal and non-commercial use of Astro Services. For additional terms that apply to the Software, see the software terms contained in the Amazon.com Conditions of Use, the Amazon.com Device Terms of Use, and the terms contained in the Legal & Compliance section of Astro or the Astro App.

1.3 Intelligent Motion. Astro can autonomously explore, navigate, and adapt to its environment to provide Astro Services, such as detecting and interacting with people, processing and reacting to inputs it receives from its sensors at any time, creating or updating its Map, responding to your requests, determining its location on the Map, avoiding obstacles, and returning to its charger when its battery is low. Astro may be present in locations that it has not specifically been directed to.

1.4 Astro Information. Amazon processes and retains your Astro Information (such as Maps or video that is streamed when you use live view) in the cloud to provide, personalize, and improve our services. Your voice interactions are processed using Alexa voice services and subject to the Alexa Terms of Use. You can control Astro by interacting with the Astro device, such as with your voice or by using the touch screen, and by using the Astro App. Learn more about Astro, including how to delete Map data associated with your account.

1.5 Visual ID. Astro can detect when a person is in its environment so that it can do things like follow someone or send an alert when it detects an unrecognized person. You can also enable Astro to recognize your face and provide you with a more personalized experience if you choose to create a visual ID. For example, you can create a Routine to adjust your smart thermostat when Astro sees you. Visual ID uses images of your face to create a numeric representation of your facial characteristics and updates this numeric representation over time to improve Astro’s ability to recognize you. When a person is within Astro’s field of view, the device uses on-device processing to attempt to match that person with the visual IDs of enrolled users. When a person is detected, Astro may send a signal to the cloud to provide enhanced features, such as initiating a Routine that is triggered when Astro sees someone or showing you in the Astro app when a user was last seen by Astro. 1.6 Home monitoring. You can enable optional Astro home monitoring features, such as the live view feature or alerts in the Astro App when Astro detects an unrecognized person. Astro Services are not monitored security services or emergency notification services. Amazon will neither monitor emergency notifications nor dispatch emergency authorities to your home. Astro Services are not a replacement for an alarm system or life safety device and cannot provide you with specific information about what to do in an emergency. You are responsible for contacting appropriate emergency authorities in the event of an emergency.

1.7 Premium Features. Certain optional features available on Astro, such as enhanced home monitoring features that enable Astro to patrol your home or automatically stream video, require a subscription from Ring or Amazon. If you purchase a subscription, or start a free trial for a subscription, through Amazon for a premium feature, the Alexa Subscription Schedule terms found in the Alexa Terms of Use, or other applicable terms provided to you, apply to that subscription.

2. General

2.1 Information. The Software will provide Amazon with information about your use of Astro or the Astro App, your Astro Information, or information otherwise collected by Astro or Astro Services (such as battery life, device status, diagnostic information, network connectivity, software performance, settings changes, who interacted with Astro on a particular day, or the fact that you opened the Astro App a certain number of times per day). This information may be stored on servers outside the country in which you live. We will handle any information we receive in accordance with the Amazon.com Privacy Notice.

2.2 Information Purposes Only. We do not guarantee that Astro Services or their functionality or content, including any notifications or alerts, are accurate, reliable, always available, timely, or complete. Astro Services are provided for informational purposes only. You agree that Amazon is not responsible for any damages caused by the failure or delay of Astro Services, regardless of whether such failure or delay is within Amazon’s control. You may encounter content through Astro or Astro Services that you find offensive, indecent, or objectionable. Amazon has no responsibility or liability for such content.

2.3 Changes to Astro Services; Amendments. We may change, suspend, or discontinue Astro Services, or any part of them, at any time without notice. We may amend any of this Agreement’s terms at our sole discretion by posting the revised terms on the Amazon.com website. Your continued use of Astro Services after the effective date of the revised Agreement constitutes your acceptance of the terms. You are responsible for maintaining appropriate security and protection of your account.

2.4 Compliance with Law. You are responsible for ensuring that your use of Astro and Astro Services complies with any applicable laws. You may not use Astro or Astro Services in a manner that is illegal, obscene, defamatory, invades privacy, infringes intellectual property (including publicity rights), or otherwise injures third parties or is objectionable. You may not use Astro or Astro Services in any manner that does not comply with this Agreement. Amazon is not liable for your use of Astro or Astro Services.

2.5 Usage Restrictions and Limitations. You may access and use Astro Services only in the United States. We may restrict access to Astro Services from other locations.

2.6 Termination. Your rights under this Agreement will automatically terminate without notice if you fail to comply with any of its terms. In case of such termination, Amazon may immediately revoke your access to Astro Services without refund of any fees. Amazon’s failure to insist upon or enforce your strict compliance with this Agreement will not constitute a waiver of any of its rights.

Astro for Business Schedule

This schedule is part of the Astro Terms of Use and you agree to these terms when you use Astro for Business or Astro Services related to Astro for Business.

1.1 Use of Astro for Business and related Astro Services. You may purchase Astro for Business and use Astro for Business and related Astro Services for your own internal and lawful business purposes (such as using Astro for Business on your business premises or allowing your employees to use or access Astro for Business); however, you may not resell Astro for Business or Astro Services, or otherwise make Astro for Business or Astro Services available for third parties.

1.2 Alexa Interactions. If you use Astro for Business, you or other people in your business (such as employees) may control Astro for Business with voice. Amazon processes and retains such Alexa interactions (other than voice recordings, which are processed and then deleted) in the cloud to provide and improve our services.

1.3 Indemnification. You agree you will be responsible for the use of Astro or Astro Services (including use by any third party you permit to use Astro or Astro Services), and you agree you will defend, indemnify, and hold harmless Amazon and its affiliates, and their respective directors, officers, employees, representatives, contractors, and agents, from and against any loss, damage, judgment, settlement, expense, interest, and any other liability (including reasonable attorneys' fees and costs) related to or arising out of any third party allegation, claim, lawsuit, or proceeding (a "Claim") relating to your use of Astro or Astro Services, or any obligations set forth in this Agreement. You will use counsel reasonably satisfactory to us to defend each indemnified Claim. If at any time we reasonably determine that any indemnified Claim might adversely affect us, we may take control of the defense at our expense. You may not consent to the entry of any judgment or enter into any settlement of a Claim without our prior written consent, which may not be unreasonably withheld.

1.4 Additional Requirements. Astro and Astro Services are not intended for use in, or in association with, the operation of any hazardous environments or critical systems that may lead to serious bodily injury or death or cause environmental or property damage, and you are solely responsible for liability that may rise in association with such use. You may not use Amazon Astro household robot in your business.

If privacy and other laws applicable in your jurisdiction may impose certain responsibilities on you and your use of Astro or Astro Services, you agree that it is your responsibility, and not the responsibility of Amazon, to ensure that you comply with any applicable laws when you use the Astro for Business or Astro Services, including but not limited to any laws or regulations: relating to the recording or sharing of video or audio content, (2) relating to collecting, using, retaining, converting, or storing biometric information or biometric identifier, (3) requiring that notice be given to or that consent be obtained from third parties with respect to your use of Astro or Astro Services (for example, laws or regulations requiring you to display appropriate signage advising others that audio/visual recording is taking place or your business collects, uses, retains, converts or stores biometric information or biometric identifier, or requiring consent be obtained or any other notice be provided for the use of Alexa), and/or (4) any laws or regulations requiring (a) that installation of any device or service which takes visual and/or audio recordings be placed at such an angle that it does not take any recordings beyond the boundary of your property (including public pavements or roads); and (b) that, if you use Astro for Business where employees are present, you comply with applicable employment laws and laws governing the monitoring of employees.

1.5 Disputes/Binding Arbitration. Any dispute or claim arising from or relating to Astro for Business is subject to the binding arbitration, governing law, disclaimer of warranties, limitation of liability, and all other terms in the Amazon Business Accounts Terms and Conditions. By using an Astro for Business, you agree to be bound by those terms. Terms related to Astro for Business in this Agreement (including this Astro for Business Schedule) are considered Feature Terms as defined in the Amazon Business Accounts Terms and Conditions.
