Welcome to the terms of use for Amazon Luna. These terms are between you and Amazon.com Services LLC (together with its affiliates, "Amazon", "we" or "us"). Please read these terms, along with the Amazon.com Privacy Notice (www.amazon.com/privacy), and Amazon.com Conditions of Use (https://www.amazon.com/conditionsofuse), and all other rules and policies related to the Amazon Luna service (including, but not limited to, any rules, conditions, or usage provisions specified on any product or service detail page, on any help or other informational page for the Amazon Luna service, or in any link from a detail page) (collectively, this "Agreement"). Each time you visit, browse, or use the Amazon Luna service, you agree to be bound by the terms of this Agreement on behalf of yourself and all members of your household and others who use the Service under your account. If you do not accept the terms of this Agreement, then you may not use the Service.
1. The Service
Amazon Luna (the "Service") is a game streaming service that offers the ability to browse, access, purchase, use, and play cloud-based streaming games and other digital goods ("Digital Content") and other services as provided in this Agreement. Digital Content includes any content, services, technology, data, add-ons (including Amazon-Sold Add-ons, as defined in Section 4(b)), PC Games (as defined in Section 4(c)), and other digital products for sale that are intended to be accessed or used within or in connection with streaming games, such as additional or enhanced functionality, virtual currency, special in-game items or characters, content, or subscription access to content or services. The party that provides Digital Content to us for distribution is the "Publisher" of the Digital Content. Most Digital Content is licensed to you by third-party Publishers.
If you are under 18 years of age, you may use the Service only with involvement of a parent or guardian. We personalize content and features as part of the Service, including showing you recommendations for Digital Content, features, and services that might be of interest to you. We also endeavor to continuously improve the Service and your experience with it.
2. Compatible Devices
In order to access and stream Digital Content through the Service, you will need to use a personal computer, a streaming media player or smart TV, a mobile device, or other device that meets the system and compatibility requirements that we establish from time to time (a "Compatible Device"). We may add more Compatible Devices, or change the requirements for Compatible Devices from time to time and, in some cases, whether a device is (or remains) a Compatible Device may depend on software or systems provided or maintained by the device manufacturer or other third parties. 3. Geographic Restrictions
The Service is currently available only in the United States, Canada, the United Kingdom, Germany, France, Italy, and Spain. Digital Content (including localized versions of Digital Content) and how we offer Digital Content to you may vary over time and by location. Amazon will use technologies to verify your geographic location. You may not use any technology or technique to obscure or disguise your location.
4. Digital Content
a. Subscription Digital Content. The Service may allow you to access Digital Content on a subscription basis during a subscription period (for example, through the Luna Premium Channel or other Luna Channels) ("Subscription Digital Content").
Offers and pricing for subscriptions, the subscription services, the extent of available Subscription Digital Content, and the specific titles available through subscription services, may change over time and by location without notice (except as may be required by applicable law). Unless otherwise indicated, any price changes are effective as of the beginning of the next subscription period. If you do not agree to a subscription change, you may cancel your subscription per Section 4(d) below. The pricing for subscriptions may include taxes. Where applicable, such taxes will be collected by the party with whom you transact for the subscription, which may be Amazon or a third party. We make no guarantee as to the availability of specific Subscription Digital Content or the minimum amount of Subscription Digital Content available in any subscription. Additional terms applicable to a subscription (such as the applicable cancellation and refund policy) will be indicated on, or linked from, the detail pages for that subscription.
Some of the subscriptions that we offer are provided by third parties. Third parties that provide subscriptions (for example, through Luna Channels) may change or discontinue the features of their subscriptions or the content in their subscriptions. Amazon is not responsible for the content contained in any third-party subscription or the features of these subscriptions.
b. Add-ons. We may offer Digital Content for sale that is intended to be accessed or used within or in connection with a streaming game, such as additional or enhanced functionality, virtual currency, special in-game items or characters, content, or subscription access to content or services ("Amazon-Sold Add-ons"). Not all products and services available for purchase within or in connection with a streaming game are Amazon-Sold Add-ons. You will be able to identify Amazon-Sold Add-Ons because you will see our branding and sold by Amazon when making the purchase and will complete the purchase using your designated Amazon payment method. Amazon-Sold Add-Ons are subject to any use, access, and other restrictions described on, or linked from, the Amazon-Sold Add-On detail page, purchase page, or otherwise provided in this Agreement.
Other than for purchases of Amazon-Sold Add-ons, we are not a party to, and have no responsibility for, any payment or purchase transactions you make within a streaming game on the Service (unless we expressly state otherwise in writing).
c. PC Games. We may offer PC games for sale, including through pre-order, that are capable of being played on the Service or on other compatible services or devices (“PC Games”). The date a PC Game becomes available to play on the Service may differ from its general public availability. We may require you to have a Luna Premium Channel or Prime subscription to play PC Games on the Service. You may also be able to download and access PC Games from the applicable Publisher or another third party such as a game store, but you are responsible for ensuring that your device meets any applicable minimum system requirements. In order to purchase, download, or play a PC Game, you may need an account with the applicable Publisher or third party, and you may need to link that account to your Amazon account. d. Cancellation of Subscriptions. If you signed up for your subscription directly through us, you may cancel your subscription any time by visiting "Your Account" and adjusting your subscription settings, by contacting Amazon customer service, or by using any cancellation form that we make available to you or, if you transact for the applicable Amazon subscription through a third party, through your account with such third party. If you cancel within 3 business days of signing up for, or converting from a free trial to, a paid subscription, we will refund your full subscription fee; except that we may charge you (or withhold from your refund) the value of the subscription used through your account during such period. If you cancel at any other time, we will refund your full subscription fee only if Subscription Digital Content available as part of your subscription has not been accessed through your account since your latest subscription charge. If you are accessing the Service as part of a subscription that you transact for through a third party, the cancellation and refund terms that apply to you may differ and are as set forth by such third party, and you may need to contact such third party to cancel your subscription or receive any refund under its applicable policies.
e. Purchases of PC Games and Add-Ons Cancellations. All purchases of PC Games and Amazon-Sold Add-ons are final, and we do not accept returns of such PC Games or Amazon-Sold Add-Ons, except as expressly stated in the Digital Products Return Policy, or if applicable, the Pre-Order Cancellation Policy.
f. Subscription Payment Methods. If you sign up for your subscription through us and are billed by us, then the billing terms described below will apply to your subscription.
If you signed up for your subscription through a third party and are not billed directly by us, then the billing terms provided by the third party will apply to your subscription.
g. Free and Promotional Offerings. We may make some Digital Content available through the Service at no charge and others for a price, as further described on our detail pages. From time to time, we may offer sales, give-aways, and other promotions on Digital Content, or free trial access to Subscription Digital Content, which are subject to this Agreement except as otherwise stated in the promotional offers. We reserve the right, in our sole discretion, to determine your eligibility. We may modify or discontinue these promotions at any time without notice to you. Trial customers may at any time (through "Your Account") choose not to continue to paid subscriptions by canceling before the end of the trial period.
h. Availability of Digital Content. Some of the Digital Content that we offer is provided by Publishers or other third parties who may change, temporarily make unavailable, or discontinue the Digital Content made available through the Service. You acknowledge and agree that in certain situations, third-party events outside of our control may impact the availability of such Digital Content. Amazon-Sold Add-ons will usually continue to be available to you as long as you have access to the applicable streaming game through the Service, but may become unavailable due to Publisher licensing restrictions, if the Publisher discontinues the streaming game, or for other reasons. PC Games may also become unavailable on the Service (or through the Publisher or another third party) due to Publisher licensing restrictions, if the Publisher discontinues the streaming game, or for other reasons. We are not responsible for any delays in the availability of PC Games on the Service, and make no representation or warranty that any Digital Content licensed to you by third party Publishers will not change or be suspended or terminated.
i. Third Party Services. Certain Digital Content, including pre-ordered PC Games, relies on cloud-based services provided by the Publisher or another third party for some or all of its functionality ("Third Party Services"). This Digital Content may not function properly or may become inoperable if the Publisher or third party discontinues those Third Party Services or fails to provide the necessary functionality by the anticipated release date. Your use of any Third Party Service is subject to any terms applicable to such Third Party Service, which may be updated from time to time. Certain of these third party terms can be found in the Digital Content, or may be linked from the Service, and may be updated from time to time. You are responsible for reading and understanding the terms and privacy and/or data security policies or notices that apply to your use of any Third Party Services. If you do not accept the third party terms applicable to a Third Party Service, do not use the Digital Content associated with that Third Party Service. Amazon has no responsibility or liability for Third Party Services or their availability. Providers of Third Party Services may change or discontinue the functionality or features of their Third Party Service. If you link your Amazon account to a Third Party Service, you are directing us to share information with that service. If you would like to request deletion of data shared with a Third Party Service, you will need to contact the provider of the Third Party Service directly.
j. Playback Quality; Streaming. The streaming resolution and quality of Digital Content as well as latency of the Service will depend on a number of factors, including the type of Compatible Device on which you are accessing Digital Content, your location, your network connection, your bandwidth (which may increase or decrease over the course of your access), and your subscription status. Your ability to access and use Digital Content may be interrupted if your connection does not meet minimum requirements or due to connectivity issues. If we detect that Digital Content we are streaming to you may be interrupted or may otherwise not play properly due to bandwidth constraints or other factors, we may optimize the streaming quality of the Digital Content in an effort to provide an uninterrupted experience. While we strive to provide you a high quality experience, we make no guarantee as to the resolution or quality of the Digital Content you will receive when streaming, even if you have paid extra for access to higher definition. You are solely responsible for any access, data, or overage fees incurred from third parties (such as your Internet provider or mobile carrier) in connection with your access and use of the Service or your download, access, and use of any Digital Content.
k. General Restrictions. You may not (i) transfer, copy, or display Digital Content, except as permitted in this Agreement; (ii) sell, rent, or lease, any right to Digital Content; (iii) stream, transmit, broadcast, or otherwise publicly perform any Digital Content (except where permitted using features of the Service or where doing so would not constitute a copyright infringement); (iv) remove any proprietary notices or labels on Digital Content; (v) attempt to disable, bypass, modify, defeat, or otherwise circumvent any digital rights management or other content protection system used as part of the Service; or (vi) use the Service or Digital Content for any commercial or illegal purpose.
5. Use of the Service and Software
a. Use of the Software. We may make available software for your use in connection with the Service ("Software"). Terms contained in the Amazon.com Conditions of Use (https://www.amazon.com/conditionsofuse) apply to your use of Software. For additional terms that apply to certain third-party Software, click . The Software and the Service are only for your personal and noncommercial use.
b. Information Provided to Amazon. The Service and Software will provide Amazon with information relating to your use and the performance of the Service and Software, as well as information regarding the devices on which you use the Service and Software. For example, the Software may provide Amazon with information related to the Digital Content that you stream and your use of that Digital Content (such as whether and when you accessed the Digital Content, your game progress, the device type, log files, network diagnostics, connectivity, location, individual session lengths, or why Digital Content may not be working). Any personal information we receive is subject to the Amazon.com Privacy Notice ().
c. Information Provided to Others. You are responsible for any information you provide to Publishers or other third parties in connection with your use of the Service or your download, access, or use of any Digital Content. Use of information you provide to these third parties will be subject to any privacy notice or other terms that they may provide to you.
d. Separate Licenses to Use Digital Content. Your access to Digital Content will be governed by the terms and conditions of an end user license agreement between you and the Publisher of the Digital Content (a "EULA"). The EULA for Digital Content includes the terms set forth below (the "Standard EULA") and any additional end user license terms included in the Digital Content (the "Publisher EULA"). If there is a conflict between the Standard EULA and the Publisher EULA, the Standard EULA will control. The Publisher has the right to enforce the EULA against you. If you do not want to comply with the EULA for Digital Content, you must not use that Digital Content. Amazon is not a party to the EULA for any Digital Content (unless Amazon is the Publisher of that Digital Content). The Standard EULA includes the following end user license terms, and if Digital Content does not include a Publisher EULA, these terms will constitute the entire EULA between you and the Publisher:
(i) The Publisher is the licensor of the Digital Content.
(ii) If the Digital Content does not include a Publisher EULA that specifies Digital Content license rights, Publisher grants you a limited, nontransferable license to access the Digital Content only for your personal and noncommercial purposes.
(iii) You may access the Digital Content on Compatible Devices that have been linked to the Amazon customer account that you used to buy or otherwise access the Digital Content through the Service in accordance with Amazon's rules and policies for the Service.
(iv) Any information that Publisher collects from you will be subject to any Publisher EULA, privacy notice, or similar terms that the Publisher provides to you, and will not be subject to the Amazon.com Privacy Notice ().
(v) You may not modify, reverse engineer, decompile or disassemble the Digital Content in whole or in part, or create any derivative works from or sublicense any rights in the Digital Content, unless otherwise expressly authorized in writing by Publisher.
(vi) The Digital Content is protected by copyright and other intellectual property laws and treaties. Unless otherwise expressly stated in the Publisher EULA, Publisher or its licensors own all title, copyright and other intellectual property rights in the Digital Content, and the Digital Content is licensed, not sold.
(vii) You acknowledge and agree that Amazon has no responsibility or liability with respect to your use of the Digital Content or any content, functionality in, or availability of, the Digital Content (unless Amazon is the Publisher of that Digital Content).
6. The Luna Community
a. Code of Conduct. To make the Service and the communities of players and fans of the Service as welcoming and enjoyable as possible for all users, you agree to abide by any applicable code of conduct and applicable law. If you violate any such code of conduct, this Agreement, applicable law, or otherwise act in inappropriate or offensive ways, we may take disciplinary action against you, including revoking or limiting your access to communication features and Digital Content, in connection with a single game, the Service as a whole, or other community areas. Any material violation may also result in the suspension or termination of your Amazon and Twitch accounts.
b. Profile Information. The profile information connected to your account, including your player name and player image, may be displayed to other players and used by us to support your account. Our applies to user-made player names on the Service.
c. Communications Features. In addition to the core gameplay features of the Service, we may include ancillary features of the Service and on related services and forums that enable you to communicate with us, and with the community. We do not guarantee that communications features will be uninterrupted, error-free, suitable for any purpose, or will remain available, and you should not rely on the availability or functionality of these communication features for any purpose.
d. Spectating, Recording, and Broadcasting. Some games on the Service may offer online multiplayer functionality and communications features. You should not expect that your multiplayer gameplay or your communications (e.g., chat) in such games will be private. We and other users may spectate, record, and broadcast your online multiplayer sessions or other sessions that you choose to broadcast through features of the Service, including your display name, voice (if you transmit your voice), likeness (if you transmit video of yourself), and metadata on your gameplay, all of which constitute material submitted to us under the Amazon.com Conditions of Use (www.amazon.com/conditionsofuse). By using such features, you grant us and other users all rights necessary to make and distribute recordings.
e. Monitoring. We may (but are not obligated to) monitor and record your game sessions and communications on the Service and related websites and services for various reasons, including to enforce this Agreement, ensure compliance with any applicable code of conduct, prevent or punish cheating, and improve the Service.
7. Additional Terms
a. Termination. We may terminate your access to the Service, including any subscriptions available as part of the Service, at our discretion without notice (except as may be required by applicable law). If we do so, we will give you a pro-rated refund of your subscription fee (if any); however, if you violate any of the terms of this Agreement, your rights under this Agreement will automatically terminate without notice, and Amazon may, in its discretion, immediately revoke your access to the Service and to Digital Content without refund of any fees.
b. Safety. Some individuals may experience lightheadedness, seizures, and/or blackouts when exposed to flashing lights or other repetitive light patterns, which can occur when playing video games. If you or any member of your household has a family history of epilepsy or of experiencing any of these conditions, consult a physician before using the Service. If you or a member of your household experiences any of these symptoms while using the Service, stop using the Service and seek medical care immediately. Children and teenagers may be more prone to these conditions than adults. Adults should monitor their children closely for these symptoms and should encourage their children to take frequent breaks when using the Service, to use the Service in a well-lit room, and to sit a reasonable distance away from the screen.
c. Explicit Content. By using the Service, you may encounter content that may be offensive, indecent or objectionable; this content may or may not be identified as having explicit language or other attributes. Nevertheless, you agree to use the Service at your sole risk, and Amazon has no liability to you for any content. We may provide age and content ratings, as well as content, genre and category descriptions, for Digital Content that are based on information provided to us by the Publisher or other third parties. While we require Publishers to provide accurate information regarding the content of their Digital Content, we cannot ensure that such ratings and descriptions are accurate or that Digital Content does not include content that is offensive, indecent, or objectionable.
d. Modification of Service. Amazon reserves the right to modify, suspend, or discontinue the Service, or any part of the Service, at any time and without notice (except as required by applicable law), and Amazon will not be liable to you should it exercise such rights, even if your ability to use Digital Content is impacted by the change.
e. Amendments. Amazon reserves the right to make changes to this Agreement at any time by posting the revised terms in connection with the Service. To the maximum extent permitted by law, your continued use of the Service or Software following any changes will constitute your acceptance of such changes. However, any increase in subscription fee will not apply until your subscription is renewed.
f. Reservation of Rights; Waiver. The Service, Software and Digital Content embody intellectual property that is protected by law. Our failure to insist upon or enforce your strict compliance with the Agreement will not constitute a waiver of any of our rights.
g. Disputes /Conditions of Use. Any dispute or claim arising from or relating to this Agreement or the Service is subject to the governing law, disclaimer of warranties and limitation of liability, dispute resolution, and all other terms in the Amazon.com Conditions of Use (https://www.amazon.com/conditionsofuse).
h. Limitation of Liability. Without limiting the disclaimer of warranties and limitation of liability in the Amazon.com Conditions of Use (https://www.amazon.com/conditionsofuse): (i) in no event shall our or our software licensors' total liability to you for all damages arising out of or related to your use or inability to use the Software exceed the amount of fifty dollars ($50.00); and (ii) in no event shall our or our Digital Content providers' total liability to you for all damages arising from your use of the Service, Digital Content, or information, materials or products included on or otherwise made available to you through the Service, exceed the amount you paid to us over the past 12 months to purchase or access Digital Content related to your claim for damages. The limitations in this section will apply to you even if the remedies fail of their essential purpose.
