Amazon Dash Terms of Use

Welcome to the terms of use for the Amazon Dash product ordering services (the "Service"). This is an agreement between you and Amazon.com Services LLC (with its affiliates, “Amazon”, “we” or “us”). Before using the Service, please read these Amazon Dash Terms of Use, the Amazon.com Privacy Notice, the Amazon.com Conditions of Use, the Amazon Device Terms of Use (if using an Amazon device), the Coupon Terms and Conditions (if applying a coupon when making a purchase through the Service), the Amazon Business Accounts Terms and Conditions (if using an Amazon Business account), and the other applicable rules, policies, and terms posted on the Amazon.com website or otherwise provided by Amazon (collectively, this “Agreement”). By using the Service, you agree to be bound by the terms of this Agreement on behalf of yourself and all members of your household and others who use the Service under your account.

1. Amazon Dash Service

The Service allows you to easily place orders for eligible products from Amazon and participating retailers using automated and other ordering methods in connection with certain eligible devices (“Dash-Enabled Devices”). The Service may provide you the option to set up automatic orders by selecting qualified products that will be ordered automatically based on the product usage and product supply level information from those devices (e.g., the remaining ink level in a printer). You can also use the Service to manually order eligible products through the virtual Dash buttons we may make available to you through the Amazon.com website or through visual displays on certain eligible devices. Automatic orders and manual orders are collectively referred to in these terms of use as “Orders”.

2. Product Selection

2.1 Automatic Orders

You can view details on how to enable and select products for automatic Order on the https://www.amazon.com/b?ie=UTF8&node=15426532011. You can view and manage your existing product selections for automatic Orders by going to Manage Amazon Dash Replenishment Settings. Your settings for automatic Orders will remain in effect until modified or cancelled.

2.2 Manual Orders

2.3 Product Substitutions

If a product you select for Order is unavailable when the Order is placed or scheduled to ship, you authorize us to fulfill your Order with a similar product that we believe will meet your expectations.  

3. Managing Your Orders

You can see the details for all Orders placed through the Service in https://www.amazon.com/gp/css/order-history/ref=oh_surl_yo. After each Order is placed, you will have a limited period of time during which you can modify or cancel an Order by going to Change Your Order Information, and you may return Orders subject to the Amazon.com Returns Policy.

4. Payment

The total cost charged to you for each Order will be the price of the product at the time the Order is placed less any applicable discounts, plus any applicable sales tax and shipping-related charges. Some Orders may be eligible for a coupon discount. Any Amazon.com eligible promotional credit balances on your Amazon.com customer account may be applied toward the balance of your Order before charging any remaining balance to your payment method. Orders will be automatically charged to your default payment method and shipped to your default shipping address. If your designated payment method is expired or declined for payment, you authorize us to charge another payment method associated with your account.

5. Offer Details

Some offer details may change as Orders are placed through the Service over time (for example, price, taxes, availability, shipping charges, and the seller). Each Order will be subject to the offer details at the time the Order is placed. Any discounts and promotions in effect at the time an Order is placed apply only to eligible products displaying the offer message on the information pages for such products or on the applicable virtual Dash button. Certain discounts will apply only to Orders placed through the Service. Manual Orders for products placed using virtual Dash buttons are only eligible for the specific discounts and promotions displayed on the applicable virtual Dash button at the time such order is placed. Certain discounts available on product detail pages may not apply to manual Orders placed using virtual Dash buttons. Orders placed through the Service are not currently eligible for AmazonSmile donations.

6. Information

The Service and any software we make available to you in connection with the Service (“Software”) may provide Amazon with information relating to your use and the performance of the Service, the Software and Dash-Enabled Devices (such as device type, name and features, when devices are used, supply levels, battery levels, internet connectivity, product selection, device and service settings, and location data).  This information may be stored on servers outside the country in which you live. We will handle any information we receive in accordance with the Amazon.com Privacy Notice.

7. Third-Party Dash-Enabled Devices

Dash-Enabled Devices may include third-party devices that Amazon does not manufacture or develop (“Third-Party Dash-Enabled Devices”). Third-Party Dash-Enabled Devices may include or use services or software provided by the device manufacturer or developer (“Device Manufacturer”) capable of collecting or receiving information regarding your use of the device, such as the type of products used with the device and the rate at which they are consumed. This information may allow us and/or the Device Manufacturer to better predict when your product supplies may need to be replenished.  If you use a Third-Party Dash-Enabled Device, we may exchange information with the Device Manufacturer related to your use of the device, including details about your Orders, Service settings, and estimated Order delivery dates. Your use of any Third-Party Dash-Enabled Device, and the Device Manufacturer’s collection and use of any data it receives, are subject to any thirty-party terms provided to you by the Device Manufacturer. Device Manufacturers may change or discontinue the functionality or features of their Third-Party Dash-Enabled Devices.  Amazon has no responsibility or liability for Third-Party Dash-Enabled Devices or Device Manufacturers.

8. General

8.1 Geographic Restrictions

The Service is operated in the United States.  We may restrict access to the Service from other locations.

8.2 Use of Software

The software terms contained in the Amazon.com Conditions of Use apply to your use of the Software. For additional terms that apply to certain third-party software, see the Legal Notices section within the Software application.

8.3 Changes to the Service; Amendments

We may change, suspend, or discontinue any or all of the Service at any time without notice. We may amend any of this Agreement's terms (including all applicable terms, conditions, limitations and requirements on the Amazon.com website) at our sole discretion by posting the revised terms on the Amazon.com website. Your continued use of the Service after the effective date of the revised Agreement constitutes your acceptance of the terms, including for any future Orders placed.  If any change to this Agreement is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions.

8.4 Termination

Your rights under this Agreement will automatically terminate without notice if you fail to comply with any of its terms. In case of such termination, Amazon may immediately revoke your access to the Service. Amazon’s failure to insist upon or enforce your strict compliance with this Agreement will not constitute a waiver of any of its rights.

8.5 Disputes

Any dispute or claim arising from or relating to this Agreement, the Service or any Dash-Enabled Device is subject to the dispute resolution, governing law, disclaimer of warranties, limitation of liability, and all other terms in the Amazon.com Conditions of Use.

8.6 Disclaimer of Warranties and Limitation of Liability

Without limiting the Disclaimer of Warranties and Limitation of Liability terms in the Amazon.com Conditions of Use, and unless otherwise required by applicable law, in no event will our or our licensors' or our service providers' aggregate liability with respect to any claim arising from or relating to this Agreement or your use of the Service exceed fifty dollars ($50).
